Motul NZ and its affiliates provide their services to you subject to the following conditions. If you visit or shop at Motul NZ, you accept these conditions. Please read them carefully. In addition, when you use any current or future Motul NZ service or visit or purchase from any business affiliated with Motul NZ, whether or not included in the Motul NZ Web site, you also will be subject to the guidelines and conditions applicable to such service or business.

When you visit Motul NZ or send e-mails to us, you are communicating with us electronically. You consent to receive communications from us electronically. LICENSE AND SITE ACCESS
Motul NZ grants you a limited license to access and make personal use of this site and not to download (other than page caching) or modify it, or any portion of it, except with express written consent of Motul NZ. YOUR ACCOUNT
If you use this site, you are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer, and you agree to accept responsibility for all activities that occur under your account or password. Motul NZ does sell products for children, but it sells them to adults, who can purchase with a credit card. If you are under 18, you may use Motul NZ only with involvement of a parent or guardian. Motul NZ and its affiliates reserve the right to refuse service, terminate accounts, remove or edit content, or cancel orders in their sole discretion.
TRADE ACCOUNTS
If you hold a trade account with High Performance Lubricants it will include mutually agreed trems, these terms could be pricing, delivery subsidies, payment time arrangements, or any similar service factors not available to consumers. Standard payment terms of trade accounts is the 20th of the following month unless agreed otherwise. High Performance Lubricants reserves the right to withhold any pricing arrangements, discounts or incentives, in full or part, that would otherwise be available at our discretion, without notice if payment terms are not adhered to.
REVIEWS, COMMENTS, COMMUNICATIONS, AND OTHER CONTENT
Visitors may post reviews, comments, and other content; and submit suggestions, ideas, comments, questions, or other information, so long as the content is not illegal, obscene, threatening, defamatory, invasive of privacy, infringing of intellectual property rights, or otherwise injurious to third parties or objectionable and does not consist of or contain software viruses, political campaigning, commercial solicitation. You may not use a false e-mail address, impersonate any person or entity, or otherwise mislead as to the origin of content. Motul NZ reserves the right (but not the obligation) to remove or edit such content, but does not regularly review posted content. COPYRIGHT COMPLAINTS
Motul NZ and its affiliates respect the intellectual property of others. If you believe that your work has been copied in a way that constitutes copyright infringement, email us with your complaint.
RISK OF LOSS
All items purchased from Motul NZ are made pursuant to a shipment contract. This means that the risk of loss and title for such items pass to you upon our delivery to the carrier.
PRODUCT DESCRIPTIONS
Motul NZ and its affiliates attempt to be as accurate as possible. However, Motul NZ does not warrant that product descriptions or other content of this site is accurate, complete, reliable, current, or error-free. If a product offered by Motul NZ itself is not as described, your sole remedy is to return it in unused condition.
OTHER BUSINESSES
Parties other than Motul NZ and its subsidiaries sell product lines on this site. In addition, we provide may links to the sites of affiliated companies and certain other businesses. We are not responsible for examining or evaluating, and we do not warrant the offerings of, any of these businesses or individuals or the content of their web sites. APPLICABLE LAW
By visiting Motul NZ, you agree that the laws of New Zealand, without regard to principles of conflict of laws, will govern these Conditions of Use and any dispute of any sort that might arise between you and Motul NZ or its affiliates.
DISPUTES
Any dispute relating in any way to your visit to Motul NZ or to products you purchase through Motul NZ shall be submitted to confidential arbitration in New Zealand, except that, to the extent you have in any manner violated or threatened to violate Motul NZ's intellectual property rights, Motul NZ may seek injunctive or other appropriate relief in any court in New Zealand, and you consent to exclusive jurisdiction and venue in such courts. Arbitration under this agreement shall be conducted under the rules then prevailing of an independent arbitrator. The arbitrator's award shall be binding and may be entered as a judgment in any court of competent jurisdiction. To the fullest extent permitted by applicable law, no arbitration under this Agreement shall be joined to an arbitration involving any other party subject to this Agreement, whether through class arbitration proceedings or otherwise.
SITE POLICIES, MODIFICATION, AND SEVERABILITY
Please review our other policies, posted on this site. These policies also govern your visit to Motul NZ. We reserve the right to make changes to our site, policies, and these Conditions of Use at any time. If any of these conditions shall be deemed invalid, void, or for any reason unenforceable, that condition shall be deemed severable and shall not affect the validity and enforceability of any remaining condition.
SALES IN LOCAL TERRITORY ONLY
This site is made available for purchases inside New Zealand only, overseas purchases are not permitted and any attemt to create an account or make purchases from outside New Zealand is in breach of these terms.
ITEM AVAILABILITY
This site does not display actual quantity of available items but instead shows the "Low Stock, Call For Availabity" icon when stock is either low or out, if you have a quantity requirement and the low stock icon is displayed please contact us to confirm availability before making your purchase, we will confirm stock and secure the items for you.
Orders are supplied on a FIFS (First in First Served) basis so it is possible for more items to be ordered than are in stock and the "in Stock" logo will display against the item until these orders are filled, in the unlikely event that you make a purchase of an item that runs out of stock because the stock is supplied to orders ahead of yours we will contact you and discuss alternative options, in no way does Motul NZ guarantee to supply alternative goods at the same price in place of your order.
Where goods cannot be supplied to an order either a refund or back order is available.
Back orders are supplied on a FIFS (First in First Served) basis, where an item is a standard stock line a back order can be cancelled any time up to point of despatch and a full refund is available, once despatched our standard returns policy applies.
Where a back order is for INDENT items the order can only be cancelled before the goods are shipped from the factory, once INDENT items are shipped from the factory a partial refund MAY be available by negotiation, but by ordering and paying for INDENT items you are making a comitment to the full order and related shipping costs. please contact our customer services team to discuss purchases or indent items.
RETRUNS/REFUNDS POLICY
Goods can be returned within 30 days of receipt for refund or exchange.
The goods must be returned new, unused, unaltered, and in saleable condition with all of the original packaging.
This right of return will not cover items that hve been especially indented, if Motul NZ proceeds to indent product(s) for a purchaser it is the responsibility of the purchaser to ensure the items are correct, for help with this the customer services team is available via phone or e-mail listed on the contact us page.
Freight costs will not be refunded, it is the responsibility of the purchaser to bare costs of return back to Motul NZ warehouse locations.
For the returns process email or phone Motul NZ with your invoice number and the reason for return. We will then discuss the returns process and approve the return before the goods are sent back for credit or exchange.
CANCELLATION
Once an order is place it can be cancelled before the goods are despatched. if an order is cancelled after the order has been despatched any delivery costs are not refundable. upon cancellation of an order the invoiced and paid amounts are available for refund or transferrable to a future order.
ORDER DELIVERY
Delivery terms are outlined at time of checkout by selecting your preferred deliver option.
if your order has to be split delivered (all items cannot be delivered together) total freight charges apply to the whole order not to each parcel. if part of the order can not be supplied the freight cost MAY be recalculated to the size/qty of the actual goods supplied, if you have any questions about freight cost please contact our customer services team from our contct us page.
